삼성전자 서비스 비정규직 전환은 부당노동 행위

삼성전자서비스 협력업체가 정규직원들을 상대로 비정규직으로 전환하는 근로계약서에 서명하도록 한 것은 법적인 정당성을 갖기 어려워 보인다.

11일 금속노조에 따르면 경북지역의 한 삼성전자서비스센터는 정규직원들을 기간제 근로자로 전환시키면서 임금이나 기타 근로조건은 종전과 동일한 수준을 유지했다. 사실상 직원들에게 어떠한 반대급부도 없이 일방적으로 불리한 계약을 강요한 것이다. 물론 센터 측에서는 직원들이 자발적으로 서명했다고 주장 할 수 있다.

하지만 부당한 강요가 없었다는 이유만으로 현저하게 불리한 내용의 근로계약이 정당화될 수는 없다.
대법원은 ‘객관적으로 급부와 반대급부 사이에 현저한 균형을 잃은 거래가 피해 당사자의 궁박 등을 이용하여 이뤄진 경우’에는 민법 104조 ‘불공정법률행위’로서 무효로 보고 있다.

이경무 공인노무사는 “사용자가 계약서에 서명하지 않으면 해고될지도 모른다는 근로자의 궁박한 사정을 이용하여 현저하게 불리한 계약을 유도했다면 불공정법률행위로 판단된다”고 밝혔다.

또한 근로계약의 변경이 삼성전자서비스 협력업체 노조가 설립 직후 나왔다는 점도 주목할 필요가 있다.

불리한 계약의 변경이 단지 법적으로 무효일 뿐 아니라 노조 활동을 위축시킬 목적의 부당노동행위로 형사처벌 대상이 될 수도 있기 때문이다.

이 노무사는 “협력업체들이 그동안 직원들에게 노조에 가입하면 계약이 해지될지 모른다고 위협하거나 특근수당을 올려주며 창립대회에 가지 못하게 하는 방법으로 노조 설립을 방해해온 점을 감안할 때 기간제로의 근로계약 변경 역시 노조 가입을 막거나 노조 활동을 무력화시키려는 부당노동행위로 보인다”고 덧붙였다
